Community-specific data on the impact of the second-generation cut-off

The Indian Register data below outlines the impact of the second-generation cut-off on each First Nation to support participation in the consultation phase of the Collaborative Process on the Second-Generation Cut-off and Section 10 Voting Thresholds.

Background

Section 6 of the Indian Act defines who is entitled to registration:

A person may be registered under 6(1) if they were born before April 17, 1985 or after that date and have 2 parents entitled to registration
A person may be registered under 6(2) if they were born after 1985 and have 1 parent entitled to registration

Individuals registered under sections 6(1) and 6(2) have equal access to rights, programs, benefits and services provided by the federal government. However, they differ in their ability to pass on entitlement to their children on their own. Currently, a person entitled under section 6(2) can only pass on entitlement to their children if the child's other parent is also entitled to registration.

How the second-generation cut-off works

The second-generation cut-off occurs after 2 consecutive generations of parenting between a person who is entitled to registration and a person who is not entitled to registration. As a result, the third generation is not entitled to registration.
